A recent decision in the Federal Court on the matter of  WorkPac Pty Ltd v Rossato [2020] concerning the potential for employers to be required to pay entitlements such as sick  leave and annual leave to long term casual employees has lead to much concern in the buiness community.  We have experienced many calls from concerned clients wondering about the implications for their business particularly regarding the potential for them to be required to backpay these entitlements within the statute of limitations (6 years)

These concerns have been fuelled by many in the media with sensationalist headlines saying that this particular case marks a “big win” for casual employees and even further by the Federal Minister for Industrial Relations Hon. Christian Porter making commentary around the potential for legislative reform in response to the decision handed down by the court.
